@ Franky looks like there is a slot for the nut if you look at the opposite side of the ruler, so it probably looks like its sitting ontop of the nut.

@wokka, yeah i see what you're saying, but on all of the necks i've tested mine on, F or G scales, you need to line that end notch up over the first fret. Maybe i do have a Dud rule? If i do as BW is doing, i get the same result, if i put that very end notch over the first fret, all the slots line up over the frets all the way down.

Nope, I'm a GOOSE! Bah hahaha
Frankie is spot on. I watched a YouTube video of a bloke with a rule that went to the nut and, when I checked mine, instantly assumed there was an issue with the guitar or rule. As it turns out the only issue was the fool trying to use the tool he does not know how to use!
Thanks heapsfor your help Wokka and Frankie and I'm terribly sorry for wasting your time. If anything I hope you got a good laugh out of it I did.

With the bridge in place, it's a non intonatable bridge, D was 627mm and G was 630mm. I also measured to the center of brige posts and they were both 628mm.
ok BW that is definitely a 24.75" scale length so plug that into the Stewmac fret calculator (628.65mm) and enter number of frets (assume 22 frets). Pretty sure I remember Dedman's DM-1S build being 24.75" scale length

Just measured all the frets with the figures that the stewmac calculator gave me and they're all pretty much spot on.
So it seems that it is the straight rule that is out as it doesn't fit from the 5th fret down and as you get down to the higher frets it gets to the point where, at the 9th fret it is sitting in the middle of the high side in between the notches.
I thought it may be the fret ruler. Maybe you can check the measurements of the slots by measuring front of the nut slot to front of all the other slots. I would ask for an exchange or a refund on your fret ruler must be a dodgy knock off
